ORDINANCE NO. 2013-1106
AN ORDINANCE OF THE CITY OF FULSHEAR, TEXAS, GRANTING TO SEAWAY CRUDE PIPELINE COMPANY
LLC, THE RIGHT, PRIVILEGE AND FRANCHISE TO LAY, REPLACE, MAINTAIN, AND OPERATE ONE
THIRTY INCH (30") PIPELINE IN THE CORPORATE LIMITS AND THE EXTRATERRITORIAL JURISDICTION
OF THE CITY OF FULSHEAR, TEXAS, PRESCRIBING THE TERMS AND CONDITIONS UNDER WHICH SAID
RIGHT, PRIVILEGE, AND FRANCHISE IS GRANTED; PROVIDING FOR SEVERABILITY; PROVIDING
FOR REPEAL; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Chapters 111 and 117 of the Texas Natural Resources Code address the issue
of municipal regulation of pipelines; and
WHEREAS, the City of Fulshear, Texas, ("City") strives to promote orderly and safe
development within the territorial limits and the extraterritorial jurisdiction of
the City; and
WHEREAS, the City Council finds that the franchise agreement with Seaway Crude Pipeline
Company LLC ("Seaway") is in the best interest of the health, safety, and welfare
of the citizens of the City;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FULSHEAR, TEXAS:
